الشروط والأحكام لاستخدام منصة دكانكم (Dukkancom.com)
أهلاً بك في منصة دكانكم. تُطبق هذه الشروط والأحكام على استخدامك للموقع الإلكتروني وكافة الخدمات والمنتجات المرتبطة به. بمجرد وصولك للموقع، أو إنشاء متجر، أو الشراء من خلاله، فإنك تقر بالموافقة الكاملة والالتزام بكافة البنود الموضحة أدناه وفقًا للقوانين والأنظمة المعمول بها في فلسطين.
1) طبيعة المنصة والتواصل المباشر
· دور المنصة: منصة دكانكم هي مزود للبيئة والنية التقنية التي تمكن التجار من إنشاء متاجرهم الإلكترونية الخاصة بعرض منتجاتهم (B2C). المنصة ليست طرفًا في أي عقد بيع أو شراء ولا تملك البضائع المعروضة.
· التواصل المباشر: يتم التواصل والتفاوض والاتفاق بين البائع والمشتري بشكل مباشر تمامًا ودون أي تدخل أو وساطة من المنصة.
2) التزامات المستخدمين والأهلية القانونية
· الأهلية القانونية: يجب أن لا يقل عمر المستخدم (سواء كان بائعًا أو مشتريًا) عن 18 عامًا أو السن القانوني للشراء وفقًا للقوانين الفلسطينية.
· دقة البيانات والإفصاح: يلتزم المستخدم بتقديم معلومات صحيحة ودقيقة (خاصة البيانات التجارية للتاجر). ويكون مسؤوليًا عن الحفاظ على سرية بيانات حسابه وكلمة المرور وعن جميع الأنشطة التي تتم من خلاله.
3) عمليات البيع، التوصيل، وحقوق المستهلك
· المسؤولية الكاملة للبائع: البائع هو المسؤول الوحيد والكامل عن إعداد، شحن، وتوصيل البضائع للمشترين، بالإضافة إلى تحصيل ثمن المنتجات بنفسه عبر وسائل الدفع التي يحددها.
· إخلاء مسؤولية المنصة عن النزاعات: المنصة غير مسؤولة عن أي خطأ أو تأخير في التوصيل أو تلف في البضائع، ولا تتحمل أي مسؤولية عن عدم دفع المشتري أو تعثر التحصيل. أي نزاع ينشأ يتم تسويته مباشرة بين البائع والمشتري.
· الامتثال لقانون حماية المستهلك: يلتزم البائع بضمان حق المستهلك في الإرجاع والاستبدال والإفصاح عن عيوب السلع وفقًا لأحكام قانون حماية المستهلك الفلسطيني وتعديلاته، ويتحمل البائع وحده التبعات القانونية عند الإخلال بذلك.
4) رسوم الاشتراك وإلغاء الحسابات
· عدم اقتطاع عمولات: تعمل منصة دكانكم بنموذج عدم اقتطاع أي نسبة أو عمولة من مبيعات التجار، وتقتصر التزامات البائع المالية على الرسوم المقررة لا اشتراك المتجر (إن وجدت).
· حق تعليق أو إلغاء الخدمة: تحتفظ إدارة دكانكم بالحق في تعليق أو إلغاء حساب أي مستخدم تثبت مخالفته للشروط، أو ورود شكاوى مثبتة بحقه، أو إساءة استخدامه للمنصة، أو خرق القوانين المعمول بها.
· تسوية الرسوم عند الإلغاء: في حال إلغاء الحساب بسبب مخالفات جسيمة للقانون أو الشروط، لا يحق للمستخدم المطالبة برسوم الاشتراك. أما في حالات الإلغاء غير الناجمة عن خرق جسيم، يتم تسوية الرسوم وإعادة المبالغ المستحقة عن الفترة المتبقية بعد خصم المصاريف الإدارية أو الأضرار المثبتة إن وجدت.
5) الأعطال والانقطاعات الفنية
· الأسباب الخارجة عن الإرادة: لا تتحمل المنصة المسؤولية عن توقف الخدمة، أو بطئها، أو عدم القدرة على الوصول للمتجر نتيجة وجود خلل عام في شبكة الإنترنت، أو أعطال في خوادم الاستضافة، أو الهجمات السيبرانية، أو القوة القاهرة، أو أعمال الصيانة الطارئة.
· العناية الواجبة: تلتزم المنصة ببذل العناية الواجبة والجهود المعقولة تقنيًا لضمان استقرار الخدمة وإعادة تشغيلها في أسرع وقت ممكن عند حدوث أي انقطاع.
6) الملكية الفكرية والامتثال للتشريعات
· حقوق المنصة: العلامة التجارية والتصميم والبرمجيات الخاصة بموقع دكانكم هي ملك حصري للموقع وحماية بموجب قوانين الملكية الفكرية.
· المنتجات المحظورة: يُحظر تمامًا عرض أو بيع أي منتجات غير قانونية، أو مقلدة، أو تنتهك حقوق الملكية الفكرية، أو تخالف النظام العام والآداب العامة في فلسطين. يتحمل التاجر المسؤولية القانونية والجزائية الكاملة عن المحتوى والمنتجات المعروضة في متجره.
7) تعديل الشروط والقانون الواجب التطبيق
· التعديل: تحتفظ المنصة بحق تعديل هذه الشروط في أي وقت، وتصبح التعديلات نافذة فور نشرها على الموقع.
8) حذف المحتوى والمنتجات المخالفة
· صلاحية الإزالة والتعديل: تحتفظ إدارة منصة دكانكم بالحق المطلق والصلاحية التامة في حذف، إزالة، أو حظر أي منتج، نص، صورة، أو محتوى يتم نشره على أي متجر، وذلك في حال رأت الإدارة – وفقاً لتقديرها المنفرد – أنه يخالف التشريعات والقوانين السارية في فلسطين، أو يتعارض مع سياسات المنصة والنظام العام، أو يُعد غير مناسب لأي سبب كان.
· إخلاء المسؤولية عن الحذف: يتم هذا الإجراء فوراً دون الحاجة لإشعار مسبق أو الرجوع للناشر (البائع)، ولا يترتب على المنصة أي مسؤولية قانونية، مالية، أو أخلاقية، ولا يحق للبائع المطالبة بأي تعويض عن أي أضرار أو خسائر ناتجة عن هذا الحذف.
Terms and Conditions for Using Dukkancom (Dukkancom.com)
Welcome to Dukkancom. These Terms and Conditions govern your use of the website and all associated services and products. By accessing the website, creating a store, or making a purchase through it, you acknowledge that you fully agree to and comply with all the terms set forth below, in accordance with the applicable laws and regulations in Palestine.
1. Nature of the Platform and Direct Communication
· Role of the Platform: Dukkancom acts solely as a technical service provider enabling merchants to establish their own e-commerce stores to display products (B2C). The platform is not a party to any sale or purchase contract and does not own any of the listed goods.
· Direct Communication: Communication, negotiation, and agreement between the seller and the buyer occur entirely directly, without any intervention or mediation by the platform.
2. User Eligibility and Obligations
· Legal Capacity: Users (whether sellers or buyers) must be at least 18 years of age or meet the legal purchasing age under Palestinian law.
· Data Accuracy and Disclosure: Users commit to providing true and accurate information (specifically the merchant’s commercial details). Users remain fully responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
3. Sales Transactions, Delivery, and Consumer Rights
· Seller’s Full Responsibility: The seller is solely and fully responsible for preparing, shipping, and delivering goods to buyers, as well as collecting payments using their chosen payment methods.
· Limitation of Liability for Disputes: The platform is not liable for any errors, delivery delays, or damaged goods, nor does it assume responsibility for non-payment by buyers or collection failures. Any disputes must be resolved directly between the seller and the buyer.
· Compliance with Consumer Protection Laws: The seller agrees to honor consumer rights regarding returns, exchanges, and the disclosure of product defects in compliance with the Palestinian Consumer Protection Law No. (21) of 2005 and its amendments. The seller assumes sole legal liability for any non-compliance.
4. Subscription Fees and Account Termination
· Zero Sales Commissions: Dukkancom operates on a zero-commission model regarding seller sales. The merchant’s financial obligations are limited strictly to the agreed store subscription fees (if applicable).
· Right to Suspend or Terminate Service: Dukkancom reserves the right to suspend or terminate any user account upon a breach of these terms, substantiated complaints, platform misuse, or violations of applicable laws.
· Settlement of Fees Upon Cancellation: In the event of account termination due to severe violations of the law or these terms, the user forfeits all subscription fees. For terminations not resulting from a material breach, unearned subscription fees for the remaining period will be refunded after deducting reasonable administrative costs or verified damages, if any.
5. Technical Interruptions and Outages
· Events Beyond Control: The platform is not liable for service interruptions, slowness, or inability to access stores resulting from general internet outages, hosting server failures, cyberattacks, force majeure events, or emergency maintenance.
· Due Diligence: The platform commits to exercising commercially reasonable due diligence to maintain service stability and restore operations as quickly as possible during any outage.
6. Intellectual Property and Prohibited Activities
· Platform Rights: All trademarks, designs, software, and content belonging to Dukkancom are the exclusive property of the platform and are protected under intellectual property laws.
· Prohibited Items: Displaying or selling illegal, counterfeit, trademark-infringing, or morally non-compliant products under Palestinian public order is strictly prohibited. Merchants bear full legal and criminal liability for the content and items listed in their stores.
7. Amendments and Governing Law
· Amendments: The platform reserves the right to update these terms at any time. Modifications become effective immediately upon posting to the website.
· Governing Law and Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws and regulations in force in Palestine. Palestinian courts shall have exclusive jurisdiction over any disputes arising from this agreement.
8. Removal of Non-Compliant Content and Products
· Right of Removal and Modification: Dukkancom reserves the absolute right and authority to delete, remove, or block any product, text, image, or content published on any store if the platform’s management deems it—at its sole discretion—to be in violation of applicable laws in Palestine, contrary to platform policies or public order, or otherwise inappropriate.
· Limitation of Liability for Removal: Such action may be taken immediately without prior notice or consultation with the publisher (seller). The platform shall bear no legal, financial, or moral liability whatsoever, and the seller shall not be entitled to claim any compensation for any damages or losses resulting from such removal.
